This Agreement is concluded between the Internet Commerce Site teal-ant-851413.hostersite.com<\/b><\/span> owner Petarde Ltd<\/b><\/span>, registration no. 40003872737<\/b><\/span>, registered on 8 November 2006, registered office at: 76 Unijas Street, Riga, LV-1082<\/b><\/span> (hereinafter referred to as Seller<\/b><\/span>), and Buyers<\/b><\/span>who places an order and makes a purchase on an online shopping site teal-ant-851413.hostersite.com<\/b><\/span> or order by phone.<\/p>\n

The Buyer shall order, purchase and pay for, and the Seller shall sell, pyrotechnics, fireworks, lanterns, confetti and other festive paraphernalia (hereinafter referred to as Products<\/b><\/span>) in accordance with the terms of this Agreement (hereinafter referred to as Contract<\/b><\/span>).<\/p>\n

The Buyer shall order the Goods by completing the relevant order form on the Seller's website teal-ant-851413.hostersite.com<\/b><\/span>. When placing an order, the Buyer undertakes to provide precise information - name, surname or company name and contact details. Personal data relating to the ordering of goods shall not be passed on to third parties. By privacy policy<\/b><\/span> can be found here.<\/p>\n

When placing an order by telephone, the Customer shall state his name, surname, telephone number, the date of receipt of the Goods ordered and, if possible, a specific time. Personal data relating to the ordering of the Goods shall not be passed on to third parties.<\/p>\n

The Seller shall make a reservation for the Goods and the Buyer may collect the Goods at the Seller's shop address selected and specified by the Buyer. Delivery of pyrotechnic articles to the address (home, workplace, etc.) indicated by the Buyer is not allowed<\/b><\/span> in accordance with the legislation of the Republic of Latvia. The goods are reserved for the amount indicated on the Seller's website at the time of reservation. The goods are reserved for one week, unless the Buyer has specified a specific date for collection of the goods.<\/p>\n

The Seller shall send an e-mail to the e-mail address provided by the Buyer for the reservation of the Goods and confirmation that the Goods are in the Shop.<\/p>\n

The buyer pays for the purchase as a prepayment by bank transfer or upon receipt of the goods by cash or credit card. The Buyer shall inform the Seller of the chosen method of payment by completing the order form.<\/p>\n

Orders may be placed by the Buyer 24 hours a day, but the Seller shall process orders within one working day of receipt of the order. The Seller shall send the Buyer a confirmation of acceptance of the order by e-mail.<\/p>\n

Upon receipt of the goods, the Buyer shall check the appearance of the goods received, their dimensions, whether they are damaged and whether the ordered goods correspond to the expected ones. The Buyer may refuse the ordered pyrotechnics until the goods are received (upon leaving the Seller's shop premises). Thereafter, the Goods shall only be returned or exchanged if the Goods are defective due to the fault of the manufacturer. Otherwise, the Goods will not be accepted back from the Buyer because the Seller cannot be sure that the Goods have been properly stored and transported.<\/p>\n

Only persons aged 18 years and over may receive pyrotechnic articles. The Seller shall be entitled to verify the age of the Buyer by asking for proof of identity. The Seller shall cancel the order and the Goods shall not be delivered if the person is under 18 years of age or if the Seller is in doubt as to the Buyer's age and the Buyer is unable to produce proof of identity.<\/p>\n

When ordering a fireworks service, the Buyer may withdraw from the service until it has been provided. If the Buyer cancels within the last 24 hours before the service is provided, the Buyer shall bear the Seller's preparation and\/or transport costs.<\/p>\n

Goods other than pyrotechnics may be returned or exchanged by the Buyer within 14 (fourteen) days from the date of receipt of the goods. In this case, the return delivery costs shall be borne by the Buyer.<\/p>\n

If the Buyer wishes to exercise the right of withdrawal, the following conditions must be taken into account:<\/p>\n

    The returned product must not be used (due to the specific nature of the product).<\/p>\n<\/li>\n

  • \n

    If the condition of the returned goods has deteriorated due to improper storage, the Buyer is not entitled to exercise the right of withdrawal.<\/p>\n<\/li>\n

  • \n

    The Buyer is obliged to preserve and not damage the original packaging of the goods.<\/p>\n<\/li>\n

  • \n

    To exercise the right of withdrawal, the Buyer must contact the Seller by e-mail info@petarde.lv<\/b><\/span>.<\/p>\n

    The Buyer receives a cancellation form from the Seller, which is filled in and sent to the e-mail address indicated above.<\/p>\n<\/li>\n<\/ul>\n

    The Seller shall transfer the money for the returned goods to the bank account specified by the Buyer in the withdrawal form within 14 (fourteen) calendar days after the termination of the contract and receipt of the goods specified in the withdrawal form at the Seller's warehouse or store.<\/p>\n

    The average lead time is 1 (one) to 6 (six) days, but the Seller reserves the right to refuse an order if the goods are out of stock in the Seller's stores or warehouse at the time of ordering and order processing. This applies in particular to seasonal sales in December.<\/p>\n

    This Agreement is concluded in accordance with the laws and regulations of the Republic of Latvia, and in the event of any disputes shall be settled in the courts of the Republic of Latvia. The Buyer acknowledges that it has read the terms of this Agreement and undertakes to observe and comply with them.<\/p>\n
